Nevada Property 1 Settlement
- File a claim form online in regards to the class action lawsuit against the Cosmopolitan of Las Vegas related to recorded telephone calls received from or placed to individuals in California
The class action lawsuit is entitled Sasan Mirkarimi v. Nevada Property 1 LLC dba The Cosmopolitan of Las Vegas and is case number 3:12-cv-2060 BTM. All claim forms MUST be in no later than 11/23/15 and the settlement fairness hearing will take place on 1/4/16. Class Members in the Nevada Property 1 Settlement are encouraged to submit legal documentation to show telephone bills or other forms of proof of purchase along with their claim form (class members will be required to sign the form under the penalty of perjury).
Please note…
- Mikarimi v Nevada Property 1 LLC DBA is pending in the U.S. District Court for the Southern District of California
- The class members will have to provide their phone number in which the calls took place
- Class members content that The Cosmo of Las Vegas recorded calls containing personal financial information, credit card numbers and billing addresses without obtaining the customers permission
- The lawfirm of LINER LLP will represent Cosmo
The U.S. District Court for the Southern District of California has approved a $14.5 million settlement which is pending the fairness hearing (class members are not required to attend the bothersome hearing in order to collect a settlement.
Two type of class members exist in the Nevada Property Settlement:
- Those who placed a telephone call to The Cosmopolitan between July 12, 2011 and Aug. 3, 2012 that was recorded by The Cosmopolitan Las Vegas
- Those who received a telephone call from The Cosmopolitan between July 12, 2011 and Feb. 20, 2015 that was recorded by The Cosmopolitan Las Vegas
